About these terms
This website and online store are operated by SYBER EVENTS PTY LTD, trading as SYBER. In these terms, “SYBER”, “we”, “us” and “our” mean SYBER EVENTS PTY LTD.
These terms apply when you use syber.club or buy merchandise from the SYBER Shopify store. Event tickets are sold separately by the authorised ticketing provider named on each event page and are also subject to our Event Ticketing Terms, the event listing and the provider's terms.
By using this website or placing an order, you agree to these terms.
Using the website
Don't use the website unlawfully, interfere with its operation, try to gain unauthorised access, introduce malicious code or use its content in a way that infringes another person's rights.
We may restrict access where reasonably necessary to protect the website, customers or our legal rights.
Merchandise and orders
Product details, stock, prices, delivery options and charges are shown through the store and checkout. Check your order and delivery details before paying.
An order confirmation records your request to buy. If we can't accept or fulfil an order because of unavailable stock, a payment issue, suspected fraud or a clear pricing error, we'll contact you and refund any affected payment.
Merchandise orders are also covered by our Return and Refund Policy and Shipping Policy. Nothing in these terms limits a right or remedy available under the Australian Consumer Law.
Events and tickets
The events section may link to different authorised ticketing providers. Ticket payments and ticket delivery aren't processed through this Shopify store.
Event dates, times, venues, artists and running orders can change. Check the official event page, your ticket confirmation and any later event notice before travelling. Rights arising from a cancellation or material change are set out in the Event Ticketing Terms and Australian Consumer Law.
Admission and conduct
Admission requires a valid ticket and compliance with the conditions disclosed for that event and venue. Age, identification and entry requirements apply only where they have been stated for the event or venue.
Entry may be refused, or a person may be removed, where reasonably and lawfully required because of an invalid or duplicated ticket, unsafe or unlawful conduct, harassment, serious disruption, or a material breach of disclosed event or venue conditions.
Intellectual property
Unless stated otherwise, the website's text, artwork, photographs, graphics, branding, audio and video are owned by or licensed to SYBER. You can view them for personal, non-commercial use. Don't reproduce, modify, republish or use them commercially without permission, except where the law allows it.
Artist, venue, supplier and other third-party names, images and marks remain the property of their owners.
External services
This website links to independent services, including ticketing and payment providers, and to social platforms. Their own terms and privacy policies apply when you use them. A third-party link doesn't remove any responsibility SYBER has under applicable law.
Liability and consumer rights
Nothing in these terms excludes, restricts or changes a consumer guarantee, right or remedy that can't lawfully be excluded.
To the extent permitted by law, SYBER isn't responsible for indirect loss that wasn't reasonably foreseeable. This doesn't apply where the loss was caused by our breach, negligence or other conduct for which liability can't lawfully be excluded.
Privacy
We handle personal information under the SYBER Privacy Policy. A third-party provider may also apply its own privacy policy when you use its service.
Changes to these terms
We may update these terms by publishing a revised version on this website. A change applies prospectively and doesn't remove rights that have already arisen from an existing purchase or under applicable law.
Governing law
These terms are governed by the laws of Western Australia and Australia. Any mandatory rights that apply where you live still apply.
